Terms of Services
Client Responsibilities
- Clients are required to provide all necessary content, details, and references before or during the project.
- Delays in providing content or feedback may result in an extension of the project timeline.
- Clients should allow for an additional ten days or more in case of project delays due to emergencies or technical issues resulting in data loss.
- If a client delays payment by more than 30 days during or after project completion, Hexaloons is not responsible for the work and will not refund the advance. Re-engaging the project requires full payment.
Behavior and Communication
- Hexaloons reserves the right to immediately suspend work if the client or any representative uses offensive language, threatens violence, or engages in abusive behavior during calls, messages, or emails. No refunds will be provided in such cases.
Payment Terms
- Clients are required to pay fifty percent as a deposit to initiate a project with Hexaloons. The remaining fifty percent must be settled before final delivery of the project.
- No final files will be delivered until full payment has been received.
- Advance payments are non-refundable under any circumstances.
Revisions
- We provide up to 4 complimentary revisions for all services.
- A revision refers to minor changes in the existing concept. A completely new concept will be treated as a new project.
- Additional revisions may incur extra charges, detailed as follows:
- Logo: Five Hundred Rupees per extra revision.
- Graphic: One Hundred Fifty Rupees per additional revision.
- Website: Nine Hundred Ninety-Nine Rupees per extra page revision.
- Motion Video: Five Hundred Rupees per extra revision for videos lasting 0 to 30 seconds.
- Refusal to pay for extra revisions may result in work suspension. If full payment has not been received, work will not be delivered.
Project Timeline and Delays
- Project timelines depend on timely communication and content submission from the client.
- Failure to respond to calls, messages, or emails within 7 days will result in a suspension of ongoing projects.
- The client has 30 days to contact Hexaloons to resume work. If there is no contact within 30 days, all pending projects will be suspended, and no refunds will be issued.
Scope of Work
- The project will be completed based on the agreed scope of work.
- Any additional work or changes beyond the agreed scope will be charged separately.
Project Cancellation
- If the client cancels the project after the work has been initiated for any reason, the paid amount will not be refunded.
- However, Hexaloons may keep the project on hold for up to 60 days on request, and the same agreed pricing will be applicable when the project is resumed within this period.
- In case the project is not resumed within 60 days, it will be treated as a cancelled project, and re-engagement will require a new agreement and pricing.
- Any subscription-based services included in the project will not be paused or extended. Their duration will continue as per the original start date, regardless of whether the project is on hold or not.
Error Disclaimer
- Clients are responsible for reviewing and approving design materials before publishing or printing.
- Hexaloons is not liable for any errors or defects found after final approval, publication, or printing.
Ownership and Usage
- Upon full payment, the final approved design files will be the property of the client.
- Hexaloons retains the right to use the work for portfolio, samples, social media, advertising, and self-promotion purposes.
File Delivery
- Final files will be delivered only after full payment is received.
- Deliverables may include print-ready files, high-resolution images, and source files (if included in the agreed scope).
Website Projects (If Applicable)
- Domain, hosting, and third-party services are the responsibility of the client unless otherwise agreed.
- Hexaloons is not responsible for issues caused by third-party platforms, plugins, or hosting providers.
Data Responsibility
- Hexaloons is responsible for the client’s data for one month after delivering the final digital files.
Printing Services
- Hexaloons does not have a printing unit but collaborates with third-party service providers for printing.
- Any defects in printed materials or damage during shipping are not the responsibility of Hexaloons.
Force Majeure
- Hexaloons shall not be held responsible for delays caused by unforeseen circumstances such as natural disasters, technical failures, illness, war, government policies, or events beyond control.
Policy Updates
- Hexaloons reserves the right to modify, amend, or update these terms and conditions at any time without prior notice.
- Continued use of Hexaloons’ services implies acceptance of the updated terms.
Governing Law
- This agreement is governed by Indian law. Legal disputes will be resolved in jurisdiction of Varanasi, India.
Severability
- In case of conflicts between this agreement and other documents, this agreement shall govern.
